What is a co-operative society?

Its very important to understand the meaning of a co-operative society from a layman term as well as legal term.

The layman dictionary meaning of "co-operative" is "involving a group of people doing the same activities together to try to achieve the same thing, rather than trying to beat each other". In simple meaning, a person who has individual identity joins a group which is formed for the purpose of a common goal and do the same kind of activities to achieve it is called co-operative group.

The Gujarat Co-operative Societies Act, 1961 was amended on 29.02.2024 which clearly had defined the difference between a Co-Operative Housing Society and a Co-Operative Housing Service Society.

As per the Gujarat Co-Operative Societies (Amendment) Act, 2024;

“(૭ખ) “સહકારી ગૃહધનમાષણ મંડળી” એટલે-

(૧) એવી મંડળી, જેનો ઉદેશ તેના સભ્યોને ગૃહધનમાષણ, રહેણાકના ઘરો અથવા ફ્લેટો માટે ખુલ્લા પ્લોટ પૂરા પાડવાનો હોય અને તેના સભ્યોને સધહયારી સુધવિાઓ અને સેવાઓ પૂરી પાડવાનો હોય;

(૨) એવી મંડળી, જેનો ઉદેશ તેના પર રહેણાક એકમ અથવા ફ્લેટ્સનું બાંિકામ કરવા માટે તેના સભ્યોને પ્લોટ ફાળવવાનો હોય અથવા તેના પર પહેલેથી જ બાંિવામાં આવેલા રહેણાક એકમો ફાળવવાનો હોય અને સોસાયટી (મંડળી) દ્વારા ભાડાપટા અથવા સંપૂણષ હકના આિારે જમીન રાખવામાં આવતી હોય અને મકાનો સભ્યોની માધલકીના હોય અથવા સભ્યોની માધલકીના બનવાના હોય;

(૩) એવી મંડળી, જેનો ઉદેશ પહેલેથી જ બાંિવામાં આવેલા અથવા બાંિવામાં આવનાર ફ્લેટો તેના સભ્યોને ફાળવવાનો હોય અને જ્યાં જમીન અને મકાન અથવા મકાનો-એ બંને સોસાયટી (મંડળી) દ્વારા સંપૂણષ હક અથવા ભાડાપટાના આિારે રાખવામાં (િરાવવામાં) આવ્યા હોય;

(૭ગ) “સહકારી ગૃહધનમાષણ સેવા મંડળી” એટલે મકાનની જાળવણી તેમજ સધહયારી સુધવિાઓ અને સેવાઓની જોગવાઈના હેતુ માટે મકાનમાં ફ્લેટોના માધલકો દ્વારા રચાયેલી મંડળી;

That means
